Welcome to Pawsitive Foster! These Terms of Service ("Terms") govern your access to and use of the Pawsitive Foster platform. By creating an account or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing and using the Pawsitive Foster platform, you accept and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use our services.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the platform. Your continued use after such changes constitutes acceptance of the new Terms.

2. Description of Service

Pawsitive Foster is a platform that helps animal rescue organizations coordinate foster care programs. Features and functionality may change as we continue to develop the platform.

3. User Accounts and Registration

Account Creation

To use Pawsitive Foster, you must:

• Be at least 18 years of age
• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Be authorized by an animal rescue organization to create an account

Account Security

You are responsible for:

• Maintaining the confidentiality of your password and account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach
• Logging out of your account at the end of each session

4. User Responsibilities and Conduct

You agree to provide accurate information, communicate respectfully, prioritize animal welfare, and use the platform in compliance with all applicable laws and your organization's policies.

Prohibited Activities

You may not:

• Use the platform for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Impersonate any person or entity or misrepresent your affiliation
• Interfere with or disrupt the platform or servers
• Attempt to gain unauthorized access to any portion of the platform
• Upload viruses, malware, or malicious code
• Scrape, copy, or aggregate data from the platform without permission
• Share your account credentials with others
• Use the platform to harm, abuse, or endanger animals
• Harass, threaten, or intimidate other users

5. Content and Data

You retain ownership of content you submit. By submitting content, you grant us a license to use, store, and display it as necessary to provide our services. Content you create may be visible to other authorized users within your organization.

You may not upload content that is illegal, offensive, infringes on intellectual property rights, or promotes harm to animals or people.

6. Organization Relationships

Pawsitive Foster facilitates connections between fosters and rescue organizations but is not a party to the relationship between you and your organization. We are not responsible for:

• Disputes between fosters and organizations
• Organization policies, procedures, or decisions
• Animal placement decisions or foster assignments
• Reimbursements, payments, or financial arrangements between users and organizations
• Animal health outcomes or veterinary care decisions

7. Privacy and Data Protection

Your use of Pawsitive Foster is governed by our Privacy Policy. We collect, use, and protect your information as described in that policy. By using our services, you consent to such collection and use.

8. Intellectual Property

The Pawsitive Foster platform, including its design, features, code, and content, is owned by Pawsitive Foster and protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or create derivative works of the platform
• Reverse engineer or decompile the platform
• Use our trademarks or branding without permission
• Remove or alter any copyright or proprietary notices

10. Disclaimers and Limitations of Liability

Service Availability

No Veterinary Advice

Pawsitive Foster is a management tool and does not provide veterinary or medical advice. Always consult with qualified veterinarians for animal health decisions.

Limitation of Liability

To the fullest extent permitted by law, Pawsitive Foster and its affiliates shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or goodwill
• Service interruptions or data loss
• Actions or omissions of other users or organizations
• Any harm to animals, regardless of cause

Our total liability shall not exceed the greater of $100 or the amount you paid us in the past 12 months.

11. Indemnification

You agree to indemnify, defend, and hold harmless Pawsitive Foster, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the platform
• Your violation of these Terms
• Your violation of any rights of another party
• Your care or treatment of animals

12. Termination

By You

You may terminate your account at any time by contacting your organization administrator or through account settings.

By Us

We may suspend or terminate your account if you:

• Violate these Terms or our policies
• Engage in fraudulent or illegal activities
• Harm or endanger animals
• Pose a security or legal risk
• Are removed by your organization

Effect of Termination

Upon termination:

• Your access to the platform will cease
• We may delete your account data per our data retention policy
• Provisions that by their nature should survive (indemnification, disclaimers, etc.) will continue to apply

13. Dispute Resolution

Informal Resolution

Before filing a claim, you agree to contact us at support@pawsitivefoster.com to attempt to resolve the dispute informally.

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law provisions.

Arbitration

Any disputes arising from these Terms or your use of the platform shall be resolved through binding arbitration, except where prohibited by law. You waive the right to participate in class action lawsuits.

14. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pawsitive Foster.
